This Privacy Policy explains how Gregoir Holding NV processes your personal data when you visit gregoir.com or any of its subsidiary websites listed under “Scope” below (the “Site”), use the products and services offered through the Site (the “Services”), or otherwise interact with us. It is intended to satisfy the transparency requirements of Article 13 of the General Data Protection Regulation (Regulation (EU) 2016\/679, the “GDPR”) and the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (the “Belgian Data Protection Act”).<\/p>\n

We encourage you to read this Privacy Policy carefully. If anything is unclear, please contact us using the details in section 14.<\/p>\n

2. Scope<\/h2>\n

This Privacy Policy applies to personal data processed in connection with:<\/p>\n

    Where a different controller is responsible for processing your data (for example, a social-media platform on which you interact with our pages), that controller’s privacy policy applies in addition to this one.<\/p>\n

    3. What personal data do we process?<\/h2>\n

    Depending on how you interact with us, we process the following categories of data:<\/p>\n

    4. Payment data:<\/strong> collected directly by our payment service providers; we receive only confirmation that payment has been made and a payment reference. We do not store your full card number.<\/li>\n
    5. Browsing data:<\/strong> items viewed, added to your cart or wish list, products reviewed.<\/li>\n
    6. Customer-support data:<\/strong> the content of your communications with us, copies of correspondence, attachments and the resolution of your request.<\/li>\n
    7. Technical and usage data:<\/strong> IP address, device identifier, browser type and version, operating system, referrer, pages visited, date and time of access, language settings, collected through cookies and similar technologies (see section 8).<\/li>\n
    8. Marketing data:<\/strong> your consent or objection to marketing communications, your interactions with our newsletters (open\/click), and your participation in surveys, contests or events.<\/li>\n<\/ol>\n

      We do not knowingly process special categories of personal data within the meaning of Article 9 GDPR (e.g. data on health, ethnic origin, political opinions). Please do not share such data with us in unsolicited messages.<\/p>\n

      Most personal data is collected directly from you when you create an account, place an order, contact us or interact with the Site. We also receive data from the following sources:<\/p>\n

        6. Who has access to your data?<\/h2>\n

        Within Gregoir Holding NV, access is limited to staff members who need it to perform their tasks (sales, customer support, IT, finance, marketing). All staff members are bound by confidentiality.<\/p>\n

        We share personal data with the following categories of recipients, all of whom act as our processors under a written agreement (Article 28 GDPR) or under their own statutory duties:<\/p>\n

        5. Customer-support tooling<\/strong> (ticket \/ helpdesk software).<\/li>\n
        6. E-mail \/ SMS service providers<\/strong> (transactional and, subject to your consent or the soft opt-in, marketing communications).<\/li>\n
        7. Analytics and marketing tools<\/strong> (only with your cookie consent).<\/li>\n
        8. Affiliated companies of the Gregoir Group,<\/strong> for internal management and reporting.<\/li>\n
        9. Professional advisors<\/strong> (lawyers, accountants, auditors), insurers and, where required by law, public authorities or courts.<\/li>\n
        10. Acquirers<\/strong> in the context of a merger, acquisition or restructuring of the Gregoir Group, subject to appropriate confidentiality undertakings.<\/li>\n<\/ol>\n

          We do not sell your personal data, and we do not engage in cross-context behavioural advertising without your prior consent.<\/strong> Where personalised advertising or analytics is used on the Site, it is conditional on the consent you give in our cookie banner.<\/p>\n

          7. International transfers<\/h2>\n

          Some of our processors are established outside the European Economic Area (“EEA”), in particular in the United States (e.g. WooCommerce, certain analytics and e-mail providers). Where we transfer personal data outside the EEA, we ensure that one of the following safeguards under Chapter V GDPR applies:<\/p>\n

          1. an adequacy decision of the European Commission, including, for transfers to the United States to a recipient certified under the EU-U.S. Data Privacy Framework (Commission Implementing Decision (EU) 2023\/1795 of 10 July 2023);<\/li>\n
          2. the European Commission’s Standard Contractual Clauses of 4 June 2021, supplemented by a transfer impact assessment and additional measures where necessary;<\/li>\n
          3. any other safeguard recognised under Article 46 GDPR or, exceptionally, a derogation under Article 49 GDPR.<\/li>\n<\/ol>\n

            8. Cookies and similar technologies<\/h2>\n

            Like most websites, the Site uses cookies and similar technologies (pixels, web beacons, local storage). A cookie is a small file placed on your device when you visit a website.<\/p>\n

            We distinguish four categories:<\/p>\n

Strictly necessary cookies<\/strong> (no consent required), needed for the Site to function, e.g. to remember the items in your shopping cart, to keep you logged in, or to secure a payment.             3. Analytics cookies<\/strong>, measure how the Site is used so we can improve it.<\/li>\n

              Functional, analytics and marketing cookies are placed only after you have given your consent through our cookie banner.<\/strong> The banner is shown the first time you visit the Site, and you can change your choices at any time through the “Cookie settings” link in the footer of every page. Refusing non-essential cookies has no consequence other than the loss of the corresponding feature; you can continue to browse and shop on the Site.<\/p>\n

              9. How long do we keep your data?<\/h2>\n

              10. Your rights<\/h2>\n

              Under Articles 15 to 22 GDPR and Articles 13 to 34 of the Belgian Data Protection Act, you have the rights described below in relation to your personal data. These rights are not absolute and apply within the conditions set out in those provisions.<\/p>\n

              3. Right to erasure \/ “right to be forgotten”<\/strong> (Art. 17), to have your data deleted in the cases listed in Article 17.<\/li>\n
              4. Right to restriction of processing<\/strong> (Art. 18), to have processing limited in the cases listed in Article 18.<\/li>\n
              5. Right to data portability<\/strong> (Art. 20), for data processed by automated means on the basis of consent or contract, to receive your data in a structured, commonly used, machine-readable format and to have it transmitted to another controller where technically feasible.<\/li>\n
              6. Right to object<\/strong> (Art. 21), at any time on grounds relating to your particular situation to processing based on our legitimate interests, and at any time without justification to processing for direct marketing.<\/li>\n
              7. Right not to be subject to automated individual decision-making<\/strong> (Art. 22), see section 11.<\/li>\n
              8. Right to withdraw consent<\/strong> at any time (Art. 7(3)), without affecting the lawfulness of processing before withdrawal.<\/li>\n
              9. Right to lodge a complaint<\/strong> with the Belgian Data Protection Authority (Art. 77), see section 12.<\/li>\n<\/ol>\n

                To exercise any of these rights, contact us using the details in section 14. We will reply without undue delay and in any event within one month of receipt of your request. That period can be extended by a further two months where the request is complex or where we receive a high number of requests; in that case we will inform you of the extension and the reasons within the first month.<\/p>\n

                We may need to verify your identity before acting on a request, in particular by asking you to confirm the request from the e-mail address linked to your account or by requesting additional information. Acting on your request is free of charge, except where it is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request.<\/p>\n

                11. Profiling and automated decision-making<\/h2>\n

                With your consent (cookie banner), we use analytics and personalisation tools that involve profiling within the meaning of Article 4(4) GDPR, for example, to recommend products, to personalise content on the Site, or to show you relevant advertising. This profiling does not produce legal effects concerning you and does not similarly significantly affect you within the meaning of Article 22 GDPR.<\/p>\n

                We do not take decisions about you based solely on automated processing, including profiling, that produce legal effects or similarly significantly affect you. You can object to profiling for direct-marketing purposes at any time by withdrawing your cookie consent or by contacting us.<\/p>\n

                12. Complaints<\/h2>\n

                If you have a complaint about how we process your personal data, we ask that you first contact us, section 14. If you are not satisfied with our response, you have the right to lodge a complaint with the Belgian Data Protection Authority:<\/p>\n

                13. Children<\/h2>\n

                In Belgium the digital age of consent is set at 13 years (Article 7 of the Belgian Data Protection Act of 30 July 2018, derogating from the GDPR default of 16). The Site is not directed at children under 13, and we do not knowingly collect personal data from children under 13.<\/p>\n

                If you are a parent or legal guardian and believe that a child under 13 has provided us with personal data, please contact us, section 14, and we will take steps to delete that data.<\/p>\n

                14. Security of your data<\/h2>\n

                We take appropriate technical and organisational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access, as required by Article 32 GDPR. These include access controls, encryption in transit, regular back-ups, network and infrastructure security, segregation of environments, staff training and a written policy on the management of personal-data breaches.<\/p>\n

                No system is impenetrable, however, and we cannot guarantee absolute security. You also play a role: please use a strong, unique password for your account, do not share it with anyone, and notify us immediately if you suspect that your account has been compromised.<\/p>\n

                      5. Waarom verwerken wij uw gegevens en op welke rechtsgrond?<\/h2>\n

                      Wanneer een verwerking is gebaseerd op uw toestemming, kunt u die toestemming op elk ogenblik intrekken, zonder dat dit afbreuk doet aan de rechtmatigheid van de verwerking v\u00f3\u00f3r de intrekking. Wanneer een verwerking is gebaseerd op ons gerechtvaardigd belang, kunt u op elk ogenblik bezwaar maken op gronden die met uw specifieke situatie verband houden (zie punt 10).<\/p>\n

                      6. Wie heeft toegang tot uw gegevens?<\/h2>\n

                      Binnen Gregoir Holding NV is de toegang beperkt tot personeelsleden die de gegevens nodig hebben voor de uitvoering van hun taken (sales, klantendienst, IT, financi\u00ebn, marketing). Alle personeelsleden zijn tot vertrouwelijkheid gehouden.<\/p>\n

                        Een lijst van onze voornaamste verwerkers is op verzoek beschikbaar via het contactadres in punt 15.<\/p>\n

                        Wij verkopen uw persoonsgegevens niet en wij doen niet aan gerichte reclame over websites heen zonder uw voorafgaande toestemming.<\/strong> Indien op de Site gepersonaliseerde reclame of analyse wordt gebruikt, gebeurt dit uitsluitend op basis van de toestemming die u in onze cookiebanner verleent.<\/p>\n

                        7. Internationale doorgiften<\/h2>\n

                        Sommige van onze verwerkers zijn gevestigd buiten de Europese Economische Ruimte (“EER”), in het bijzonder in de Verenigde Staten (bv. WooCommerce, bepaalde analyse- en e-mailproviders). Wanneer wij persoonsgegevens buiten de EER doorgeven, zorgen wij ervoor dat een van de volgende waarborgen op grond van Hoofdstuk V AVG van toepassing is:<\/p>\n

                        1. een adequaatheidsbesluit van de Europese Commissie, met inbegrip van, voor doorgiften naar de Verenigde Staten aan een ontvanger die gecertificeerd is onder het EU-VS Data Privacy Framework (Uitvoeringsbesluit (EU) 2023\/1795 van de Commissie van 10 juli 2023);<\/li>\n
                        2. de modelcontractbepalingen van de Europese Commissie van 4 juni 2021, aangevuld met een transfer impact assessment en bijkomende maatregelen indien nodig;<\/li>\n
                        3. elke andere waarborg erkend op grond van artikel 46 AVG of, uitzonderlijk, een afwijking op grond van artikel 49 AVG.<\/li>\n<\/ol>\n

                          8. Cookies en vergelijkbare technologie\u00ebn<\/h2>\n

                          Zoals de meeste websites maakt de Site gebruik van cookies en vergelijkbare technologie\u00ebn (pixels, web beacons, lokale opslag). Een cookie is een klein bestand dat op uw toestel wordt geplaatst wanneer u een website bezoekt.<\/p>\n

                            Functionele, analytische en marketingcookies worden uitsluitend geplaatst nadat u via onze cookiebanner uw toestemming hebt verleend.<\/strong> De banner verschijnt bij uw eerste bezoek aan de Site en u kunt uw keuzes op elk ogenblik wijzigen via de link “Cookie-instellingen” onderaan elke pagina.                             Wij bewaren uw persoonsgegevens gedurende de periode die nodig is voor de in punt 5 vermelde doeleinden, rekening houdend met onze wettelijke verplichtingen.                             10. Uw rechten<\/h2>\n

                            Op grond van de artikelen 15 tot en met 22 AVG en de artikelen 13 tot en met 34 van de Belgische Privacywet beschikt u over de hieronder beschreven rechten met betrekking tot uw persoonsgegevens. Deze rechten zijn niet absoluut en gelden binnen de in die bepalingen bepaalde voorwaarden.<\/p>\n

                            3. Recht op gegevenswissing \/ “recht op vergetelheid”<\/strong> (art. 17), uw gegevens laten wissen in de in artikel 17 opgesomde gevallen.<\/li>\n
                            4. Recht op beperking van de verwerking<\/strong> (art. 18), de verwerking laten beperken in de in artikel 18 opgesomde gevallen.<\/li>\n
                            5. Recht op overdraagbaarheid van gegevens<\/strong> (art. 20), voor gegevens die wij langs geautomatiseerde weg verwerken op basis van toestemming of overeenkomst, uw gegevens ontvangen in een gestructureerd, gangbaar en machineleesbaar formaat en, waar technisch mogelijk, laten overdragen aan een andere verwerkingsverantwoordelijke.<\/li>\n
                            6. Recht van bezwaar<\/strong> (art. 21), op elk ogenblik om redenen die met uw specifieke situatie verband houden tegen verwerkingen op basis van ons gerechtvaardigd belang, en op elk ogenblik en zonder motivering tegen verwerkingen ten behoeve van direct marketing.<\/li>\n
                            7. Recht om niet onderworpen te worden aan louter geautomatiseerde besluitvorming<\/strong> (art. 22), zie punt 11.<\/li>\n
                            8. Recht om uw toestemming in te trekken<\/strong> op elk ogenblik (art. 7, lid 3), zonder afbreuk te doen aan de rechtmatigheid van de verwerking v\u00f3\u00f3r de intrekking.<\/li>\n
                            9. Recht om een klacht in te dienen<\/strong> bij de Gegevensbeschermingsautoriteit (art. 77), zie punt 12.<\/li>\n<\/ol>\n

                              Om een van deze rechten uit te oefenen, neemt u contact met ons op via de gegevens in punt 15. Wij antwoorden zonder onnodige vertraging en in elk geval binnen \u00e9\u00e9n maand na ontvangst van uw verzoek. Die termijn kan met twee maanden worden verlengd indien het verzoek complex is of indien wij een groot aantal verzoeken ontvangen; in dat geval brengen wij u binnen de eerste maand op de hoogte van de verlenging en de redenen daarvoor.<\/p>\n

                              Wij kunnen uw identiteit moeten verifi\u00ebren alvorens een verzoek te behandelen, met name door u te vragen het verzoek te bevestigen vanaf het e-mailadres dat aan uw account is gekoppeld of door bijkomende informatie op te vragen. Het behandelen van uw verzoek is kosteloos, behalve indien het kennelijk ongegrond of buitensporig is, in welk geval wij een redelijke vergoeding kunnen aanrekenen of het verzoek kunnen weigeren.<\/p>\n

                              11. Profilering en geautomatiseerde besluitvorming<\/h2>\n

                              Met uw toestemming (cookiebanner) gebruiken wij analyse- en personaliseringstools die profilering inhouden in de zin van artikel 4, punt 4) AVG, bijvoorbeeld om producten aan te bevelen, inhoud op de Site te personaliseren of u relevante reclame te tonen. Deze profilering heeft geen rechtsgevolgen voor u en treft u niet op vergelijkbare wijze aanmerkelijk in de zin van artikel 22 AVG.<\/p>\n

                              Wij nemen geen besluiten over u die uitsluitend zijn gebaseerd op geautomatiseerde verwerking, met inbegrip van profilering, en die rechtsgevolgen voor u hebben of u op vergelijkbare wijze aanmerkelijk treffen. U kunt op elk ogenblik bezwaar maken tegen profilering ten behoeve van direct marketing door uw cookietoestemming in te trekken of door contact met ons op te nemen.<\/p>\n

                              13. Kinderen<\/h2>\n

                              In Belgi\u00eb is de digitale meerderjarigheid voor toestemming vastgesteld op 13 jaar (artikel 7 van de Belgische Wet van 30 juli 2018, dat afwijkt van de standaardleeftijd van 16 jaar in de AVG). De Site is niet gericht op kinderen jonger dan 13 jaar en wij verzamelen niet bewust persoonsgegevens van kinderen jonger dan 13 jaar.<\/p>\n

                              Bent u ouder of wettelijke vertegenwoordiger en meent u dat een kind jonger dan 13 jaar ons persoonsgegevens heeft verstrekt, neem dan contact met ons op, punt 15, zodat wij die gegevens kunnen wissen.<\/p>\n

                              14. Beveiliging van uw gegevens<\/h2>\n

                              Wij nemen passende technische en organisatorische maatregelen om uw persoonsgegevens te beschermen tegen vernietiging, verlies, wijziging, ongeoorloofde verspreiding van of ongeoorloofde toegang tot deze gegevens, hetzij per ongeluk, hetzij onrechtmatig, zoals vereist door artikel 32 AVG. Deze maatregelen omvatten onder meer toegangscontrole, versleuteling tijdens het transport, regelmatige back-ups, netwerk- en infrastructuurbeveiliging, scheiding van omgevingen, opleiding van het personeel en een geschreven beleid voor de behandeling van datalekken.<\/p>\n

                              Geen enkel systeem is echter onfeilbaar en wij kunnen geen absolute beveiliging garanderen. Ook u speelt een rol: gebruik een sterk en uniek wachtwoord voor uw account, deel het met niemand, en breng ons onmiddellijk op de hoogte indien u vermoedt dat uw account werd gecompromitteerd.<\/p>\n
